New Wage Notice Requirement

As of January 1st, all California employers are required to provide each non-exempt employee, at the time of hire, a written notice that provides information regarding the payment of his or her wages.

The notice needs to include:

  • the rate of pay and the basis for payment (i.e., hourly, salary, piece, commission, etc.) including any overtime rates;  
  • any allowances claimed as part of the minimum wage;  
  • the regular payday;  
  • the legal name of the employer;  
  • the physical address of the employer's main office or principal place of business;  
  • the employer's telephone number; and  
  • the name, address and telephone number of the employer's workers' compensation carrier.   

Any changes in compensation must be reflected in new notices within seven (7) days of the change unless the change results in the reclassification of the employees as exempt from overtime.
